Terms and Conditions Aware4Youth
Aware4Youth, established at Torenallee 20, 5617 BC Eindhoven, registered with the Chamber of Commerce under number 65101219.
1. Definitions
Services: non-medical support focused on structure, overview and daily functioning, as well as related activities within this framework.
Customer: the party entering into the agreement and responsible for payment
Client: the person receiving the services
Customer and client may be the same person
2. Applicability
These terms apply to all quotations and agreements
Deviations are valid only if agreed in writing
By accepting a quotation or using the services, these terms are accepted
3. Formation of the agreement
All quotations are non-binding and valid for the period indicated
An agreement is formed as soon as:
the quotation has been accepted in writing, or
written consent is evident, or
the services have actually commenced
Aware4Youth may suspend performance until receipt of a signed quotation
4. Nature of the services
Aware4Youth provides non-medical support focused on structure, overview and daily functioning.
Services from age 18 up to and including 60+.
If applicable, the support can be used within WLZ-PGB (personal budget) and does not concern care in kind (ZIN) or an WMO provision.
The services are not a medical treatment and do not replace care from doctors or other care providers.
Aware4Youth has an obligation of effort, not an obligation of result
5. Performance and use of third parties
Aware4Youth determines the manner of performance
Aware4Youth may engage third parties with the consent of the person concerned / interested party
Aware4Youth is not liable for acts of third parties, unless there is intent or gross negligence
6. Obligations of the customer
The customer provides correct and complete information
The customer is responsible for timely payment
Incorrect information is at the customer’s risk
7. Payment
Payment must be made within 14 days, unless otherwise agreed
In case of late payment, statutory interest and collection costs are due
Aware4Youth may suspend work if payment is not made
8. Cancellation and termination
Termination is confirmed in writing or by email.
Work already performed will be invoiced
Cancellation arrangements may vary by service
9. Liability
Aware4Youth is only liable for direct damage
Liability is limited to the invoice amount
Indirect damage is excluded
Aware4Youth is not liable for:
choices or actions of the client
interpretation of the support by a third party engaged.
use of information outside its context
Liability for third parties is excluded, unless there is intent or gross negligence
10. Force majeure
Aware4Youth is not liable in the event of force majeure, including illness or circumstances beyond its control
11. Privacy and confidentiality
Aware4Youth handles personal data carefully
Processing takes place in accordance with the GDPR
Aware4Youth has a duty of confidentiality
12. Complaints procedure
Complaints can be submitted via info@aware4youth.nl
Aware4Youth handles complaints carefully and within a reasonable period
The client may use a complaints officer
If necessary, the complaint can be submitted to the Healthcare Disputes Committee General
13. Intellectual property
All materials developed by Aware4Youth remain the property of Aware4Youth
14. Changes
Aware4Youth may make changes to its general terms and conditions at any time whenever it deems this necessary.
15. Applicable law and disputes
Dutch law applies
Disputes will be submitted to the competent court
